THOMAS A. SCUTTI

Tom has enjoyed establishing his mediation practice after over 30 years as a litigator in Southern California. He has created a niche in personal injury and lemon law cases. He successfully completed the mediation program at the Strauss Institute for Dispute Resolution at the Pepperdine School of Law. He currently serves as a mediator throughout Southern California and has served as judge protem/civil law settlement officer at the San Diego Superior Court.

Tom started PersuasionPoint Mediation Services in September 2019 after serving as a mediator in the community for over 10 years.  He is currently on the San Diego Superior Court panel and is also retained by attorneys in the community, many of whom have litigated cases with him. Tom's mediation style is both evaluative and facilitative. He combines his decades of legal expertise with principles of emotional intelligence and listening skills to connect with the parties to make them feel comfortable with the mediation process. Tom strives to make participants feel that the process was fair, that they obtained a successful result and that they "had their day in court."

Since becoming an attorney in 1988, Tom has represented insurance companies, Fortune 100 companies, and closely-held business in general liability, transportation, trucking, consumer warranty, and lemon law claims. He was previously the supervising partner of the law and motion department, has extensive jury and bench trial experience, has handled over 100 mediations and arbitrations, and has successfully defended multiple appellate matters before the Second and Fourth District Courts of Appeal.

SPEAKING + WRITING

Tom speaks at industry-related seminars throughout the country and has been a presenter for the National Business Institute on topics related to civil litigation.

Tom also writes on topics related to mediation strategy, best practices and developments in the law related to mediations.
